On July 20, 2001, a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $3,000 was issued for a Severity Level III violation the failure to control and maintain constant surveillance of a portable density gauge that resulted in the loss of the gauge. Although the normal civil penalty assessment process would have fully mitigated the civil penalty, a penalty was proposed in accordance with Section VII.A.1.g of the Enforcement Policy to emphasize the significance of the loss of licensed material in this case.
